Heard learned counsel for the applicant and learned A.G.A. for the State.

By means of the present application under Section 482 Cr.P.C., the applicant has sought for a suitable direction to the learned Court below to consider and decide the application no.26 (Kha), dated 22.11.2021 filed under Section 91 CrPC in S.T. No.1564/2021, case crime no.269/2021, under Section 272, 273, 304, 120-B, 420, 467, 468, 471 IPC & 60(A) Excise Act, P.S. Khair, District Aligarh, pending before the Court of Additional Sessions Judge, Court No.1, Aligarh.

It was submitted by learned counsel for the applicant that applicant is accused of the above stated case, which is pending before the court of Additional Sessions Judge, Court No.1, Aligarh. The grievance of the applicant is that an application under Section 91 CrPC has been filed by the applicant on 22.11.2021 but the same has not been decided by the court below so far and thus, the court below may be directed to decide the case within specific period of time.

In view of aforesaid, the Additional Sessions Judge, Court No.1, Aligarh is directed to consider and decide the above stated case expeditiously, preferably within a period of two months from the date of filing of certified copy of this order before the Court concerned, provided there is no legal

impediment.
