Heard learned counsel for the applicant and learned A.G.A. for the State.
By means of the present application under Section 482 Cr.P.C., the applicant has sought for a suitable direction to the Civil Judge (J.D.), Court No. 20, Deoria to decide the proceedings of case no. 698 of 2019 in complaint case no. 2481 of 2017, (Uma Shankar Prasad vs. Smt. Indu Devi), under Section 138 of N.I. Act expeditiously within time stipulated by this Court, which is pending before the aforesaid court.
It was submitted by learned counsel for the applicant that applicant is the complainant of the case and he has filed the above-stated complaint against the private respondent on 09.10.2017, but no progress in trial has been made so far. Learned counsel further submits that a direction may be issued to the concerned court to decide the aforesaid complaint case within specific time.
In view of aforesaid, the Civil Judge (J.D.), Court No. 20, Deoria is directed to consider and decide the above-stated complaint case expeditiously, preferably within a period of six months from the date of production of copy of this order before the court concerned, provided there is no legal impediment.
The instant application under Section 482 Cr.P.C. is disposed of accordingly.
