This is a petition by the plaintiff of Original Suit No. 1034 of 2015 seeking a direction to the Trial Court to decide his suit within a determinate period of time.

In compliance with the order of this Court dated 17.01.2022, the In-Charge/Civil Judge (Junior Division), West Ballia has submitted a report dated 19.01.2022, the material part whereof reads thus:

उक्त ममूल ववाद इस न्यवायवालय मम ददनवानांक 19-09-2015 कके सनांससस्थित हहआ। ददनवानांक 19-9-2015 कको अनांतररिम दनषकेधवाजवा हकेततु पवास्थिरनवापत्र 6 ग 2 परि सतुनववाई करितके हहए पदतववाददीगण कको नकोदटिस दनगरत दकयवा गयवा। पत्रवावलदी मम दनयदमत दनयत दतथस्थिययों मकेम पक्षकवारियों दवारिवा पसत त ु पवास्थिरनवापत्र /ववानांदछित अन त ुकोष/सस्थिगन पवास्थिरनवापत्रयों कके अनतुसवारि कवायरववाहदी अग्रसरि हकोतदी रिहदी। अग्रकेत्तरि दनयत दतथस्थि 01.02.2016 कको ववाददी दवारिवा पसत त ु पवास्थिरनवापत्र 25 ग 2 बवावत ममौकके कवा सककेलदी नक्शवा मय ररिपकोटिर जररियके अथधवक्तवा आयतुक्त मं नांगवायके जवानके परि पक्षकवारियों ककी उपससस्थिदत ममनां सतुनकरि आदकेश पवाररित दकयवा गयवा। ददनवानांक 27-9-2016 कको असस्थिवाई दनषकेधवाजवा पवास्थिरनवापत्र 6 ग 2 परि सशतर असस्थिवाई दनषकेधवाजवा जवारिदी करितके हहए उभय पक्षयों कको दवववाददत भमूदम कके बवावत दमौरिवान मतुकदमवा यस्थिवाससस्थिदत कवायम रिखनके कवा आदकेश पवाररित दकयवा गयवा। दनयत दतथस्थि 249-2019 कको ववाददी दवारिवा पसत त ु पवास्थिरनवापत्र 91 ग 2 बवावत सतुनववाई करिनके 87 ग 2 जको दवववाददत आरिवाजदी कके सनांबनांध मम पवाररित यस्थिवाससस्थिदत आदकेश कवा अनतुपवालन पदतववाददीगण दवारिवा करिवायके जवानके कवा पतुनरआदकेश पवाररित करिनके हकेततु स्थिवा , सतुनववाई कके पश्चवात दनरिसत दकयवा गयवा। दनयत दतथस्थिययों कके अग्रकेत्तरि क्रम मम ददनवानांक 02-8-2021 कको ववाददी ककी तरिफ सके पसत त सनांशकोधन पवास्थिरनवापत्र 94 क 1 व उक्त पवास्थिरनवा पत्र परि पदतववाददी ककी आपथत्त 98 ग 2 दनसतवाररित दकयवा गयवा। अग्रकेत्तरि 25-1-2022 / कवायरववाहदी कके क्रम मम पत्रवावलदी ददनव ा न ां क कक ो अदतरर ि क जव ्त ा वबदक े हद तनकक ी ह हकेततु दनयत ककी गयदी हहै। इस पकवारि यह सपष्ट हहै दक उक्त ववाद दनयदमत रूप सके ववानांदछित /आवश्यक कवायरववाहदी मम अग्रसरि हहै। उपरिकोक्त वदणरत ववाद कके आदकेशपत्र परि अनांदकत आदकेश ककी कवायरववाहदी कके अनतुक्रम मम वतरमवान ववाद कके दनसतवारिण ममनां ककोई कवायरववाहदी न्यवायवालय कके सतरि परि दवलसमबत हकोनवा पररिलदक्षत नहहीं हको रिहवा हहै।

Looking to the nature of the order that this Court proposes to pass, issue of notice to the private respondents is dispensed with. However, in case, the said respondents feel aggrieved, it shall be open to them to make an application in this decided petition.

Apart from the substantial part of the report that has been extracted above, it is also mentioned there that incumbent Presiding Officer, Mr. Arun Kumar Gupta is on earned leave. This Court expects that earned leave will not be utilized by Judicial Officers as if it were a credit in a bank account. The dockets of Court are full and the Judicial Officers are expected to go an extra mile to discharge their pious obligations.

A perusal of the report shows that though the proceedings are not uneventful but far greater dispatch is required. This is particularly so as the petitioner here is said to be a 76 year-old man and, therefore, a senior citizen. He desires to see a terminus to the litigation during his lifetime. He has the right to expect that and the Court is obliged to fulfill that expectation of his.

In the circumstances, the Trial Judge is directed to proceed with the suit in the manner that one date every week shall be fixed when effective hearing is done. In case an adjournment is sought, the case shall be posted after two days of the date on which adjournment is sought and the weekly hearing shall be rescheduled accordingly. The Trial Court is directed to proceed with the suit and conclude the trial within a period of six months.

In the event, on account of the Covid-19 proliferation, and under the circulars of this Court on the administrative side, there are difficulties in holding trial physically, the witness shall be heard through Video Conferencing and the case shall be treated as urgent. For the purpose, the learned District Judge, consistent with the administrative circulars of this Court, shall devise ways and means for the Trial Judge to conclude the trial as directed by this Court. It is emphasized that learned counsel for the parties shall not abstain from their professional obligation because of any resolution of the Bar Association.

This petition is disposed of in terms of the aforesaid order.

Let this order be communicated to the Trial Court concerned through the District Judge, Ballia and to the learned District Judge, Ballia by the Registrar (Compliance) within 48 hours.
