In compliance with the orders of this Court dated 17.01.2022, the Civil Judge (Senior Division), FTC, Varanasi has submitted a report dated 20.01.2022. The material part whereof reads:

5- यह ककि पपूरर किके न्ययाययालययों दयारया रयाद किके कनिस्तयारण हकेततु सम्पपूणर प्रययास ककियके गयके हहै। रयाद किके कनिस्तयारण मम जजो भभ करलम्ब कियाररत हहआ हहै। रह रयाकदयया दयारया करकभन्न प्रकियार किके प्रकिकीणर प्रयाररनियापत्र प्रस्त त ु ककियके जयानिके र किजोकरड -19 किके प्रभयार किके कियारण हहआ हहै। अभभ भभ इस स्तर तरया रयाद यजोजजत हजोनिके किके इतनिभ लम्बभ अरजधि किके पश्चयात रयाकदयया किकी ओर सके रयादपत्र मम ससंशजोधिनि हकेततु प्रयाररनियापत्र प्रस्त त ु ककियया गयया हहै। जजससके स्पष्ट हजोतया हहै ककि रयाकदयया दयारया प्रस्त त प्रयाररनियापत्र किके कियारण अभभ भभ पत्रयारलभ अनन्तम कनिस्तयारण किके स्तर पर निहहीं हहै। इस प्रकियार रयाकदयया दयारया रयाद किके कनिस्तयारण मम उकचत सहयजोग निहहीं ककियया जया रहया हहै।

आदरणभय महजोदय सके करनिम्र कनिरकेदनि हहै ककि उक्त आख्यया किजो मयानिनिभय न्ययाययालय किके समक्ष रखके जयानिके किकी किकपया किरम। मयानिनिभय न्ययाययालय सके अकतकरनिम्रतयापपूररकि ससम्मयानि प्रयाररनिया हहै ककि उक्त आख्यया किके सयाप क े इस न्ययाययालय मम कियायर किकी अजधिकितया (कितुल लनम्बत जसकरल रयाद 4849), र रयाकदयया किके स्रयसं किके आचरण र रयाद किकी रतरमयानि नस्रकत किजो दृकष्टगत रखतके हहयके उकचत आदकेश पयाररत किरनिके किकी किकपया किरम। मयानिनिभय न्ययाययालय दयारया पयाररत आदकेशजो किके अनितुपयालनि हकेततु प्रयारर सदहैर तत्पर हहै।

Looking to the nature of the order that this court proposes to pass, issue of notice to private respondents is dispensed with. However, in case, the said respondents feel aggrieved, it shall be open to them to make an application in this decided petition.

Considering the age of the suit, in the entirety of circumstances, it is ordered that the Trial Court will now expedite proceedings of the suit and proceed with the trial in the manner that one date of effective hearing shall be fixed every week. The pending interlocutory applications shall be disposed of within a month and the suit shall be tried and disposed of within six months next in accordance with law after hearing both sides and their witnesses. It is further provided that if a party seeks adjournment, the case shall be taken up on the following date. It is further directed that the proceedings or the trial of the suit shall not be adjourned to accommodate the absence of learned counsel on account of any resolution by the Bar Association of which their Members to abstain from judicial work. This direction has been issued bearing in mind the decision of the Supreme Court in District Bar Association, Dehradun through its Secretary vs. Ishwar Shandilya and others, 2020 SCC Online SC 244.

The learned counsel appearing in this case are directed to assist the Court on

every date fixed ignoring any resolution of the Bar Association of which they are members to abstain from judicial work. The learned counsel appearing in this case shall not seek adjournment even on the ground of a condolence meeting in the Bar.

This petition is disposed of in terms of the aforesaid order.

Let this order be communicated to the Trial Judge concerned through the District Judge, Varanasi by the Registrar (compliance) within 48 hours.
