In compliance with the order dated 17.01.2022, the Civil Judge (Senior Division), Chandauli has submitted a report dated 21.01.2022, material part whereof reads thus:
4- यह ककि ववाद ससंख्यवा-22 सनन् 2016 छसंगगुररी ददेवरी बनवाम शरीलवा ददेवरी आकद अदद्योहस्तवाक्षररी किदे समक्ष प्रथम बवार कदनवासंकि 28-09-2021 किद्यो पदेश हहयरी तथवा उक्त कतथथ किद्यो हरी अदद्योहस्तवाक्षररी किदे दवारवा ववाकदनरी किदे प्रवाथरनवा पत्र किवागज ससंख्यवा 31 कि असंतगरत आददेश-1 कनयम-10(2) सरी.परी.सरी. किवा कनस्तवारण ककियवा गयवा तथवा अकग्रिम आददेश हदेतगु कदनवासंकि 28-11-2021 कनयत किकी गयरी। उक्त कनथथ किदे पश्चवात पत्रवावलरी मम कदनवासंकि 03-02-2022 कनयत हहै। न्यवायवालय दवारवा ववाद कदनवासंकि 1611-2017 किद्यो एकिपक्षरीय सवाक्ष्य मम कनयत ककियदे जवानदे किदे पश्चवात सदे आज किकी कतथथ तकि ववाकदनरी किदे दवारवा किद्योई सवाक्ष्य न्यवायवालय मम दवाथखिल नहहीं ककियवा गयवा , थजस किवारण ववाद लममबत हहै। न्यवायवालय दवारवा ववाद किवा कनस्तवारण यथवाशरीघ ककियदे जवानदे किवा प्रयवास ककियवा जवा रहवा हहै।
A perusal of the said report shows that the suit has been set down for ex parte hearing since 16.11.2017 but till date the plaintiff has not found it convenient to lead her evidence, which, in a suit proceeding ex parte, would mean no more than filing affidavits. Instead, the plaintiff-petitioner has approached this Court seeking a direction to expedite trial but did not find it convenient to lead her evidence in the suit proceeding ex parte since 16.11.2017. To approach this Court in the face of such conduct, asking for a direction to expedite trial, is an abuse of process of Court.
This petition is, accordingly, rejected .
Let this order be communicated to the Civil Judge (Senior Division), Chandauli through the learned District Judge, Chandauli by the Registrar (compliance) within 48 hours .
