Heard the counsel for the petitioner.
The present petition has been filed by the petitioner praying for a direction directing the Civil Judge(Senior Division), Bansgaon, Gorkahpur to decide Application No.7-C filed under Order 39 Rule 1 C.P.C in original Suit No.1193 of 2019 (Suraj Rai versus Bhagelu Prasad and others).
The Civil Judge(Senior Division), Bansgaon, Gorkahpur is directed to decide the aforesaid Application No.7-C within a period of three months from the date a copy of this order is produced before him, in case, there is no legal impediment in deciding the aforesaid application.
It is clarified that this Court has not expressed any opinion on the merits of the claim made by the petitioner.
With the aforesaid direction, the writ petition is disposed of.
