Heard Sri Ashutosh Mishra, learned counsel for the petitioners and learned AGA for the State.
After making long arguments it transpires that the petitioners have approached this Court thrice. Earlier the coordinate Bench of this Court while considering the Application u/s 482 No.17205 of 2020, vide order dated 26.11.2020, passed the order that operation of non bailable warrant shall remain stayed for a period of 30 days provided the applicants/petitioners Pradip Kumar Dixit and others utilize this period for surrendering and getting themselves bailed out.
Sri Mishra, learned counsel for the petitioners contends that on account of unforeseen reason the petitioners could not abide by the direction of this Court dated 26.11.2020. Learned counsel for the petitioners undertakes that now the petitioners would abide by the direction of this Court sincerely and faithfully and would appear and get themselves bailed out within the stipulated period as fixed by this Court.
Under the circumstances, further 30 days time is granted to the petitioners for surrendering and getting themselves bailed out. Thereafter, it will be open for the petitioners to seek a discharge under appropriate Sections of the CrPC before the court concerned. During this period of 30 days, no coercive action shall be taken against the petitioners.
With the aforesaid observations, the petition is finally disposed of.
