Learned counsel for the petitioner and learned A.C.S.C. for the State are present.
The instant petition has been moved on behalf of petitioner with the following prayer:-
"i. issue a writ, order or direction in the nature of mandamus commanding the opposite parties concerned to grant the fair price shop license in favour of the petitioner relating to village Panchayat Devariya, Block Phoolbehad, Tehsil Lakhimpur, District Kheri in favour of the petitioner on compassionate ground in place of his adopted father Late Ram Kishore in the interest of justice.
ii. issue a writ, order or direction in the nature of mandamus commanding the opposite parties concerned to take the necessary action on the application/objection dated 27.8.2022 of the petitioner as contained in annexure-1 to this writ petition and grant the fair price shop license in favour of the petitioner on compassionate grounds in place of his adopted deceased father Late Ram Kishore expeditiously within the stipulated time as provided by this Hon'ble Court in the interest of justice."
At this stage, learned counsel for the petitioner has submitted that he does not want to press the present petition and requested that liberty may be given to him to file a fresh.
Accordingly, the present petition is dismissed as not pressed with aforesaid liberty.
