Heard learned counsel for petitioners as well as learned Additional Government Advocate for State.

The present 482 Cr.P.C. application has been filed to quash the charge sheet dated 1.11.2015 and summoning order dated 5.11.2018 as well as the entire criminal proceedings of Crime No.403 of 2015, pending in the court of II ADJ/Special Judge, SC/ST Act (P.A.) Act, Hardoi .

Notice to respondent No.2 is dispensed with.

Learned counsel for applicant submits that the applicants were not taken in custody during investigation and only because the charge-sheet has been filed, she is not required to send to jail in view of the law law laid down by Supreme Court in Criminal Appeal No.929 of 2021 Aman Preet Singh versus C.B.I. through Director.

In backdrop of aforesaid decision and keeping in view the entirety of facts and circumstances of the case and having regard to the submissions of learned counsel for the applicants, the application is disposed of with a direction to the trial Court that if the bail application is filed by the petitioners before it within a period of two weeks from today, the same shall be considered and disposed of expeditiously, keeping in view the law laid down by Supreme Court in order dated 2.9.2021 passed in Criminal Appeal No.929 of 2021 Aman Preet Singh versus C.B.I. through Director .
