Heard learned counsel for applicants as well as learned Additional Government Advocate for State and perused the record.
By filing this 482 Cr.P.C. application, the applicants have prayed to quash/ set aside the impugned judgment and order dated 11.11.2021 passed by Addl. Sessions Judge, Court No.10, Sultanpur in S.T. No.315 of 2017 under sections 307/34, 504, 506 I.P.C., P.S. Gosaiganj, district Sultanpur, State vs. Junaid as against the petitioners.
A prayer for stay of the impugned proceedings of S.T.No.315 of 2017 has also been made.
Notice to respondent No.2 is dispensed with.
It is further submitted that the applicants were not taken in custody during investigation and only because the charge-sheet has been filed, they are not required to send to jail in view of the law law laid down by Supreme Court in Criminal Appeal No.929 of 2021 Aman Preet Singh versus C.B.I. through Director.
In backdrop of aforesaid decision and keeping in view the entirety of facts and circumstances of the case and having regard to the submissions of learned counsel for the applicants, the application is disposed of with a direction to the trial Court that if the bail application is filed by the petitioners before it within a period of two weeks from today, the same shall be considered and disposed of expeditiously, keeping in view the law laid down by Supreme Court in order dated 2.9.2021 passed in Criminal Appeal No.929 of 2021 Aman Preet Singh versus C.B.I. through Director .
