Heard Mr. A.Z. Siddiqui, learned counsel for the petitioners, learned State Counsel and Mr. V.K. Srivastava holding brief of Mr. Ashish Kumar Agarwal, learned counsel representing the Nagar Palika Parishd Sandila, District Hardoi.

By means of this petition a prayer has been made for issuing a direction for conducting an enquiry into the tender process which was initiated in November, 2020. Further prayer is that in case any irregularity is found, then a direction be issued for taking action against the then Executive Officer of the Nagar Palika Parishad concerned.

The tender in respect of which this petition has been filed was floated on 18.11.2020. Learned counsel representing the Nagar Palika Parishad, Sandila, District Hardoi has brought to the notice of this Court the fact that the tender notice was also published in a newspaper having wide circulation in Tehsil Sandila, District Hardoi. The tender was floated for the work relating to solid waste management material recovery facility. Learned counsel representing the Nagar Palika Parishad also states that after finalization of the tender process the work has also been executed.

Filing a petition in respect of a tender process initiated in the month of November, 2020 at this juncture, in our considered opinion, would not be permitted for the reason it is too late in the day to entertain any such petition. The tender was floated on 18.11.2020 and thereafter the tender process was completed and the work is also said to have been completed.

For the aforesaid reasons, we are not inclined to entertain this writ petition, it is hereby dismissed .
