Heard learned counsel for the petitioners and Sri Omendra Pratap Singh, learned counsel representing the Nagar Nigam, Lucknow.

By means of this writ petition, a prayer has been made for issuing a direction to the respondents to provide the facility of individual Toilet to the petitioners under Swachch Bharat Mission Scheme which is being run with the support of Government of India.

The said Scheme in the city of Lucknow is being administered by the Nagar Nigam, Lucknow.

Learned counsel the Nagar Nigam, on the basis of instructions received, has submitted that the petitioners have not made any application in the prescribed proforma. He has further stated that the Applicant User Guide has been issued in this regard and any person seeking the said facility needs to apply on-line. The Applicant User Guide and the Format of application have been brought to our notice, which are taken on record. The said documents have also been furnished to the learned counsel for the petitioners as well.

It has been stated by learned counsel for the Nagar Nigam that in case any such application is made in proper proforma and all requisite formalities are fulfilled, the consideration to provide facility of Toilet shall be made in favour of the petitioners.

Accordingly, in view of the aforesaid, we dispose of this petition with the liberty to the petitioners to make appropriate application in the prescribed proforma within 10 days from today. In case any such application is made, the same shall be considered by the authority concerned of the Nagar Nigam and adequate facility of private Toilet, if the petitioners are eligible for the same, shall also be provided to them within next four weeks.
