On being pointed out that the petitioner would be better advised to invoke Section 17 of The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, learned counsel for the petitioner has very fairly stated that the petitioner may be permitted to withdraw the writ petition with the liberty to move the Debts Recovery Tribunal under Section 17 of The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

Sri Prashant Kumar Srivastava, learned counsel representing respondent bank does not have any objection to the said prayer.

Accordingly, this writ petition is disposed of with the liberty to the petitioner to seek alternative remedy available to him under the law. If the petitioner moves any application under Section 17 of The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, the same shall be considered and decided by the Tribunal in accordance with law, with expedition.
