Heard Sri A.K. Maurya, learned counsel for the petitioner and Sri Devesh Vikram, learned Standing Counsel for the Staterespondents.

The present petition has been preferred by the petitioner for the following reliefs:-

"(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 & 3 as (District Magistrate Varanasi & S.S.P., Varanasi) to remove the illegal encroachment of Police Constables of Police Chauki Harauha, Police Station Baragaov, District Varanasi over the Plot no. 179 situated at Village Harauha, Pargana Aathagaova Tehsil Pindra District Varanasi bhumidhary land of the petitioner.

(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to 4 to not to interfere in peaceful possession and use of Bhumidhary land as Plot No. 179 situated at Village Harauha Pargana Aathagaova, Tehsil Pindra District Varanasi of the petitioner."

At the very outset, learned Additional Chief Standing Counsel states that in case the petitioner approaches the competent authority with an appropriate application ventilating his grievance, the same would be considered and decided expeditiously.

In the facts and circumstances of the case, no useful purpose would be served in keeping the writ petition pending consideration, on consent and without expressing any opinion on the merits of the issue, the writ petition stands disposed of asking the petitioner to move a fresh representation before the District Magistrate, Varanasi/respondent no. 2 ventilating his grievance within three weeks from today. In case, any such representation is being preferred, the District Magistrate, Varanasi would consider and decide the same strictly in accordance with law seeking necessary comments from the Senior Superintendent of Police, Varanasi, as expeditiously as possible and preferably within six weeks thereafter.

The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity

proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.

The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
