Heard learned counsel for the petitioner and learned Standing Counsel for the State-Respondents.

On 18.6.2021 this Court has passed the following order:-

"Learned Standing Counsel prays for and is granted a week's time to obtain instructions, specifically, on the point that under what authority, the sealing of the restaurant of petitioner is being continued since 5.10.2020.

Put up as a fresh case on 30th June, 2021."

Learned Standing Counsel has stated on the basis of the instruction that if the petitioner moves an appropriate application before the Respondent no. 3 along with an undertaking to follow the Covid-19 guidelines, then his application shall be immediately considered by the Respondent No. 3 and appropriate order in accordance with law shall be passed.

In view of the aforesaid and with the consent of learned counsel for the parties, we dispose of this writ petition giving liberty to the petitioner to make an appropriate application before the Respondent No. 3 along with his undertaking to follow the Covid-19 guidelines. If such an application is filed within a week from today along with copy of this order, the same shall be decided by Respondent No. 3 in accordance with law expeditiously, preferably within next one week, after giving reasonable opportunity of hearing to the petitioner.

With the aforesaid observation, the writ petition is disposed of.

It is made clear that we have not made any opinion on the merits of the case of the petitioner.
