The present writ petition under Article 226 of the Constitution of India has been filed for direction to competent authority, to decide the objections of the petitioner filed against show cause notice dated 10.9.2020 registered as case No. D 202015510001393 and 202015510001394 (State Vs. Raghvendra Singh) pending before District Magistrate, Mau filed under Section 17 (3) of Arms Act, 1959 within the stipulated period of time.
It is submitted by learned counsel for petitioner that the petitioner applied for renewal of his two firearm licence on 22.11.2019 before District Magistrate, Mau. In the meantime, show cause notice was issued, which was replied by the petitioner on 10.9.2020. The same is pending till date.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and an appropriate direction may be issued to respondent no. 2- District Magistrate, Mau, to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merit of the case and with the consent of the parties, the writ petition is disposed of with a direction to respondent no. 2- District Magistrate, Mau to decide the objection of the petitioner filed against show cause notice dated 10.9.2020 registered as case No. D 202015510001393 and 202015510001394 (State Vs. Raghvendra Singh) pending before District Magistrate, Mau filed under Section 17 (3) of Arms Act, 1959 of the petitioner within a period of one month from the date of production of computerized copy of this order.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
The writ petition is disposed of.
