Present writ petition has been filed for issuance of mandamus directing the court below i.e. Motor Accident Claim Tribunal, Muzaffarnagar to decide the M.A.C.P. No. 205 of 2019 (Samseer and others Vs. Usman and others) within stipulated time.
It is submitted by learned counsel for the petitioner that the petitioner has filed a claim before Motor Accident Claim Tribunal Court/District Judge, Muzaffarnagar in which issues have been framed and the case is fixed for evidence. It is next submitted that several dates have been fixed, but the tribunal court has not decided the case till date.
In the facts and circumstances of the case, the present application is finally disposed of with the direction to the Motor Accident Claim Tribunal, Muzaffarnagar to decide the M.A.C.P. No. 205 of 2019 (Samseer and others Vs. Usman and others) to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, as expeditiously as possible, preferably within a period of a year, if there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present application is finally disposed of.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
