In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioners have preferred the present writ petition with the prayer to issue a writ of mandamus directing the respondent No.2 i.e. Naib Tehsildar Pratappur Tehsil-Handia, DistrictPrayagraj to decide the case No. 271/973, 272/974, 273/975 and 274/976 (Devendra Misra Rudra Prasad) under Section 35 of U.P. Revenue Code within time bound period.
It has been stated that a mutation case under Section 35 of the U.P. Revenue Code filed by the petitioners in the year 2019 has not been decided finally till date.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent No.2 i.e. Naib Tehsildar Pratappur, Tehsil-Handia, District-Prayagraj to consider and decide the aforesaid case in accordance with law expeditiously and preferably within a period of two months from the date of submission of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
