Sri Ashutosh Dwivedi, Advocate holding brief of Sri Baleshwar Chaturvedi, learned counsel for the respondent is present.
The petitioner has challenged the demand notices dated 12.09.2020 and 08.10.2020 issued in the name of one Nizam son of Riyazuddin who is resident of Shami Apartment, Sarsaiyad Nagar, Aligarh.
The contention of the petitioner herein, who is named as Nizamuddin son of Bazrooddin, is that he is neither the resident/occupant of the said premises nor is owner thereof. On some misconception about name of the defaulter, the demand notices had been served upon the petitioner.
The contention in the writ petition is that the officer who is posted as Tehsildar, Aligarh is illegally pressurizing the petitioner to recover the amount mentioned in the impugned demand notices. The said person has not been impleaded in the writ petition. No mandamus as such can be issued. The demand notices issued in the name of a third person cannot be quashed at the instance of the petitioner.
At this stage, learned counsel for the petitioner prays for and is granted permission to withdraw the writ petition with liberty to file a fresh writ petition with better particulars.
The writ petition is dismissed as withdrawn.
