Heard learned counsel for the petitioner and Sri Kaushalendra Nath Singh, learned counsel for the NOIDA.

The petitioner is before this Court assailing the order impugned dated 17.12.2020, whereby, the lease of plot no. A-117, Sector 136, NOIDA has been cancelled.

Learned counsel for the petitioner in support of his submissions has placed reliance upon the judgment passed by this Court in Sudarshan Kumar Kapur And Another Vs. State of U.P. and New Okhla Industrial Development Authority And 2 Others (Writ-C No. 19793 of 2020, dt. 1.12.2020) and as such it is sought to be contended that the present matter is squarely covered by the aforesaid judgment and the similar treatment may also be extended to the petitioner.

The above said argument of learned counsel for the petitioner is not being disputed by Sri Kaushalendra Nath Singh, learned counsel for the NOIDA.

The writ petition is accordingly disposed of in terms of Sudarshan Kumar Kapur (supra). The Chief Executive Officer (CEO), NOIDA, District Gautam Buddh Nagar shall consider the request of the petitioner for grant of one more year for making completion of the construction over the plot in dispute in accordance with the amended Ordinance, 2020. A reasoned and speaking order shall be passed, accordingly, within a period of three weeks from the date of receipt of a copy of this order. The order impugned dated 17.12.2020 shall be subject to the fresh decision to be taken by the Chief Executive Officer, NOIDA.

The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning

the mobile number to which the said Aadhar Card is linked.

The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
