Heard Shri Shyam Shankar Shukla, learned counsel for the petitioner, learned Standing Counsel for the State respondent nos.1 and 2 and Shri Shiv Kumar Singh, learned counsel for Nagar Nigam, Aligarh.
Learned counsel for the petitioner states that so far as the grievance of the petitioner is concerned, he has already filed a representation dated 17.12.2020 before the respondent no.3 for redressal of his grievance, which is still pending. He has confined his prayer only to the relief that his representation dated 17.12.2020 may be considered by the appropriate authority.
Shri Shiv Kumar Singh, learned counsel for the contesting respondent nos.3 and 4 apprises to the Court that the "Sabhaya Mazadoor Sangh" is a registered Society in Nagar Nigam, Aligarh. Initially, the election on the post of President was held on 15.12.2020, wherein both the petitioner as well as respondent no.4 have secured equal votes. Thereafter, fresh election took place and the result has also been declared on 09.2.2021.
In the facts and circumstances, we are of the opinion that the cause of filing the writ petition no more survives and accordingly, the writ petition is dismissed as infructuous. Order Date :- 12.2.2021 RKP
