Heard learned counsel for the parties through video conferencing mode.
The petitioner has sought for the following relief in this writ petition:
"To issue a writ, order or direction in the nature of mandamus directing the respondent No.2 to pay the awarded amount Rs.1,00000/- to the petitioner which was passed by the respondent No.1 vide order dated 31.05.2017 in Claim Petition No.52 of 2013 (M/s. A2Z Infrastructure Limited Vs. Raj Kapoor Kamal) with 7% interest within a specific period as may be fixed by this Court."
Learned Standing Counsel points out that the petitioner has an alternative remedy for seeking execution of the labour court award under the Uttar Pradesh Industrial Disputes Act, 1947.
Faced with this, Sri Dheeraj Kumar Dwivedi, learned counsel for the petitioner does not press the relief sought in the writ petition and seeks leave to invoke the aforesaid remedy under the Uttar Pradesh Industrial Disputes Act, 1947.
In light of the submission made by the learned counsel for the petitioner, it is open to the petitioner to avail the appropriate remedy in law.
With the aforesaid observation, the writ petition is finally disposed of.
