Petitioner claims to be a society and has placed on record the certificate of registration issued to the society. It is alleged that there are 52 members, who are basically street vendors, but the authorities are not permitting them to operate their stall or run their shops etc.
Attention of the Court has been invited to the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 as well as rules framed thereunder, in order to submit that the authority is expected to identify vending zones/regions and grant licences for the purposes of running stalls/shops. It is stated that petitioner has also made specific application for award of licence but the matter has not been considered, so far.
Learned Standing Counsel states that the application of petitioner can be examined by the competent authority, in accordance with law.
In the facts of the case, we provide that members of petitioner's association may make their independent application in the format prescribed under the Act of 2014 and rules framed thereunder, and in the event such applications are presented by them the competent authority under the Act shall examine it and pass necessary orders, as is contemplated in law, expeditiously.
With the observations made above, this writ petition stands disposed off.
