It is admitted by learned counsel for the petitioner that the amount shown in the impugned recovery certificate represents the alleged embezzled amount which the petitioner is ready to deposit but he wants to deposit it in easy installments.
We are of the view that the relief for payment of embezzled amount in installment cannot be granted under writ jurisdiction under Article 226 of the Constitution of India. The writ petition is, therefore, dismissed .
