Sri Shobh Nath Pandey, learned counsel for the appellant/applicant states that the appellant/applicant has died for which a Substitution Application No.13 of 2021 was moved but now even the heirs of the deceased-appellant do not want to press the Appeal and the Substitution Application and, therefore, the Substitution Application as well as the Appeal may be dismissed as not pressed.
Learned standing counsel has no objection to the aforesaid request.
In view of the aforesaid, the Substitution Application No.13 of 2021 and the Special Appeal both are dismissed as not pressed.
