Heard learned counsel for the petitioner and Sri Pankaj Srivastava, learned counsel for the respondent-Bank.

Petitioner is before this Court with a request commanding the respondent to release amount of Rs. 4,86,023/- in favour of the petitioner and his brothers which is deposited in the respondent-Bank. With a further request commanding the respondent to take appropriate action on application of the petitioner dated 10.08.2020.

At the very outset, learned counsel for the Bank raised an objection that in absence of succession certificate of late Ram Ashrey Yadav, the application of the petitioner cannot be processed.

Confronted with this situation, learned counsel for the petitioner states that definitely the petitioner would invoke the remedy as available in law and after obtaining succession certificate, he would move an appropriate application for release of the aforesaid amount.

In the facts and circumstances of the case, with the consent of the parties, the writ ptition stands disposed of with a direction to the respondent-Bank that in case the petitioner furnishes succession certificate, definitely, the respondentBank would proceed strictly in accordance with law expeditiously.

The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.

The concerned Authority/Official shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
