Sri Yadavendra Dwivedi, learned counsel for the petitioner fairly submits that the petitioner has an alternative remedy of taking the order of cancellation of his license in appeal. He however contends that the petitioner could not file the appeal in time because of Covid-19 pandemic conditions the appeal is time barred as of now.

The only prayer made by the learned counsel for the petitioner is that the petitioner may be permitted to file appeal and the same may be decided on merits.

Learned Standing Counsel does not have any serious objections to the aforesaid prayer.

Heard learned counsel for the parties.

Covid-19 pandemic has dislocated lives. Substantive rights of the petitioner are engaged in

the controversy. Remedy of appeal cannot be denied because of disruptions caused by Covid19 pandemic.

In the wake of preceding discussion interest of justice will be served by passing the following directions:

(1) The petitioner shall file an appeal within one month from the date of receipt of copy of this order downloaded from the official website of the High Court of Judicature at Allahabad. The concerned Court/ Authority/ Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.

(2) In case the appeal is filed with the aforesaid period the appeallate authority shall make all endeavour to decide the same on merits in accordance with law without going into the issue of delay.

The writ petition is disposed of.
