Learned counsel for the petitioner does not disputes the submission of learned Standing Counsel that the petitioner has an alternative remedy of taking out appropriate proceedings under the U.P. Revenue Code, 2006 for eviction of the alleged encroachers upon public land as well as his land.
Learned counsel for the petitioner does not press the relief sought in this writ petition. He recast his relief and submits that the petitioner may be permitted to take out proceedings under the U.P. Revenue Code, 2006.
It is always open to the petitioner to avail legal remedies.
The writ petition is disposed of.
