Heard Sri Saroj Kumar Yadav, learned counsel for the petitioner and Sri Arvind Singh, learned counsel for the respondents.
By the impugned order dated 06.07.2021 the District Supply Officer has restrained the petitioner from functioning as a manager of the fair price shop. The fair price shop dealership was awarded to a cooperative society under the name and style of Kendriya Upbhokta Sahkari Bhandra Limited, Civil Line Road, Jaunpur.
There is no privity of contract between the petitioner and the State. Discontinuance of the petitioner as a manager has been made on the foot of an order passed by the cooperative society in that regard. As far as the fair price shop dealership is concerned the petitioner has no right once the parent cooperative society which is the licensee has discontinued him.
No cause for interference in the impugned order dated 06.07.2021 is made out.
It is open to the petitioner to take action against the discontinuance/removal against the cooperative society. In case, such dispute is raised by the cooperative society, the competent authority/court shall decide the same without being influenced by any observations made in this order.
The writ petition is dismissed.
