Heard Sri A.P. Singh, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Present writ petition has been filed for issuance of writ of mandamus directing the concerned authorities to remove the illegal encroachment from plot no. 52/0.0610 hectare, is recorded as Khalihan and plot no. 94/0.012 hectare is recorded as drain (nali) in the revenue records situated at village Ahirauli Hanuman Singh, Tehsil Tamkuhi, District Kushinagar.
It is submitted by learned counsel for the petitioner that proceeding under Section 67 of U.P. Revenue Code, 2006 has been initiated against respondent no.5 on 25.4.2017, which remain pending till date.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to concerned respondent to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, with the consent of the parties and without adverting into merits of the case, the writ petition is disposed of with direction to respondent no.4-Assistant Collector/Tehsildar, Tehsil Tamkuhi, District Kushinagar to conclude the proceedings initiated against respondent no.5 under Section 67 of U.P. Revenue Code, 2006, in accordance with law, as expeditiously as possible, after hearing all the the parties, preferably within a period of six months from the date of production of certified/computerized copy of this order.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
