Heard Mr. N.S.N. Verma, learned counsel for petitioner, learned Standing Counsel representing respondents- 1, 2 and 3.
Pursuant to order dated 28.9.2021, passed by this Court respondent-1 Sub Divisional Officer/Magistrate, Bilaspur is present in Court.
Learned Standing Counsel has filed a short counter affidavit in Court today which is taken on record.
At the very outset, learned Standing Counsel submits that 1.11.2021 is the next date fixed in the matter pending before respondent-1. Learned Standing Counsel on basis of intimation received from respondent-1 submits that aforementioned case shall be proceeded with all expectation and decided at the earliest.
In view of above, grievance raised by petitioner has now been rendered infructuous.
Accordingly, present writ petition is disposed of finally on the undertaking given by respondent-1 who has appeared in person that hearing of Case No. 37 of 2005-06 (Jan Bahadur Vs. Virendra Singh) under section 33/9 of U.P. Land Revenue Act, 1901 has already commenced and shall be concluded shortly. This Court does not have any reason to doubt the bonafide expressed by respondent-1 Sub Divisional Officer/Magistrate Bilaspur. Consequently, present writ petition is disposed of finally on the undertaking given by respondent-1.
