Heard learned counsel for the parties and perused the record.
The petitioner herein claims to be working on the post of Gram Panchayat Adhikari in Block Rajpura, District Sambhal.
The prayer in the writ petition is to quash the order dated 4.5.2020 passed by the Chief Development Officer, Sambhal, whereby charge to the post of Assistant Development Officer (Panchayat), Vikas Khand, Gunnaur, District Sambhal has been given to respondent no. 4 namely Sri Rajesh Chaudhary in addition to the charge of Assistant Development Officer (Panchayat), Vikas Khand Bahjoi.
Placing the Government Orders dated 23rd November, 2015 and 21st January, 2018, it is vehemently argued by the learned counsel for the petitioner that additional charge of the post the Assistant Development Officer (Panchayat) cannot be given to any other Assistant Development Officer (Panchayat), only the senior most Gram Panchayat Adhikari working in the concerned district can be given additional charge of Assistant Development Officer (Panchayat) in case of any vacancy.
Learned Standing Counsel supplied the copy of the written instructions given by the District Panchayat Raj Adhikari, Sambhal, wherein it is stated that pursuant to the order dated 8th July, 2020 of the Director (Panchayati Raj), U.P., Lucknow, one Sri Baburam newly promoted Assistant Development Officer (Panchayat) had been appointed on the vacant post of Assistant Development Officer (Panchayat) in Vikas Khand Gunnaur, District Sambhal.
The office order dated 28.8.2020 passed by the District Panchayat Raj Officer, Sambhal for appointment of Sri Baburam as Assistant Development Officer (Panchayat), Vikas Khand Gunnaur, Sambhal has been placed alongwith the written instructions.
In view of the said development, the writ petition is rendered infructuous.
Dismissed as such.
