When the matter was taken up learned counsel for the respondents has placed before the Court the order passed by the Civil Judge (Senior Division), Agra in Execution Case No. 109 of 2019 wherein the order was passed while disposing of the application 4 Ga on 03.02.2021. Pursuant to the order passed in the execution proceedings the actual physical possession of the property was handed over to the contesting respondents on 17.02.2021.
In view of the said fact, writ petition has become infructious as actual physical possession has already been given to the contesting respondents.
Dismissed as infructuous.
Interim order, if any, stands vacated.
