This writ petition arises out of proceedings under Section 21 (1) (a) of the U.P. Urban Building Regulation of (Letting Rent & Eviction), Act 1972.

The application filed by the respondent (landlord) was allowed by the order impugned dated 04.02.2019 against which a rent appeal no. 09 of 2019 was preferred by the petitioner (tenant) which was dismissed vide order dated 18.01.2021, against the said order present writ petition has been filed.

After hearing learned counsel for the parties, this Court finds that no interference is required in the orders impugned passed by the court below. However, Sri Atul Dayal, learned Senior Counsel, submitted that petitioner may be granted one year time to vacate the premises (shop in question).

Sri P.K. Jain, learned Senior Counsel, appearing for the respondent (landlord), very fairly accepted the proposal so made by learned counsel for the petitioner (tenant) and does not oppose the prayer for grant of time for vacating the shop in question.

In view of the said fact, writ petition is dismissed, granting one year time to the petitioner (tenant) to vacate the shop in question subject to his giving undertaking before the Prescribed Authority within a period of one month from today in regard to the fact that he would vacate the premises within one year from today. During this period, petitioner (tenant) shall deposit the monthly rent of Rs. 3,000/- to the respondent (landlord).
