The present petition has been filed alleging that the petitioner was initially appointed under the Dying-in-Harness Rule on account of death of his father on Class-III Post. Subsequently, in terms of an Advertisement issued for appointment on the post of Junior Engineer, the petitioner applied and was selected, however, subsequently on a complaint was made the entire selection was cancelled and thus the appointment of the petitioner as a Junior Engineer stood cancelled.

The petitioner claims that he is entitled to continue on the post of the clerk on which he was working prior to his selection as a Junior Engineer. He also claims that he has filed representation which is pending consideration before the respondent no. 2, however, no decision has been taken thereupon.

Considering the limited submission made at the Bar and after hearing Sri Pranjal Mehrotra, counsel for the respondent, the present writ petition is
