Petitioner claims that he was entitled to promotion from the post of Mate to the post of Supervisor. No service rules have been produced which establish the fact that the promotion avenue of Mate is that of Supervisor.
It is contended that some other similarly situated persons have been promoted to the aforesaid post. The petitioner has been discriminated.
Learned Standing Counsel contends that one illegal promotion cannot justify another. Secondly the right of promotion be seen in light of the applicable rules.
Since the petitioner has already made a representation for redressal of his grievance it would be appropriate that the authority should look into his grievance and decide the claim of the petitioner as per law preferably within a period of four months from the date of receipt of a certified copy of this order.
The writ petition is disposed of.
