construc t ion of house. It is further averred that the defendant-appellant being an influential person, has tried to purchase the land in question and wants to take possession over the land. As the defendant had tried to take possession over the land, suit for injunction was filed on 30.07.1999. The defendant-appellant contested the suit and filed written statement. It was averred that after the sale deed was executed by Smt. Pyari Devi in favour of the plaintiff in the year 1983, one Mewa had filed a suit against the plaintiff and Pyari Devi being suit suit No.87 of 1983 on the ground that Pyari Devi had already sold the land in favour of Mewa Lal. Till 1986, Mewa Lal contested the suit but thereafter left it abundant. As the financial condition of plaintiff deteriorated due to the litigation, he purchased another land in Awas Vikas Colony Mahadev Jhankhandi and required money to deposit the instalment. He wanted to sell the land. Defendant-appellant being employed in the railway and having been retired in September, 1995 and was not having any residence in Gorakhpur wanted to construct house. He agreed to purchase the land in question from the plaintiff-respondent for Rs.65,000/-.
