Heard Ms Rama Goel Bansal, learned counsel for the petitioner. Notice need not be issued to the respondents at this stage.

This writ petition has been filed against the order dated 5.4.2021 by which the stay application filed by the petitioner-revisionist has been deferred.

It is contended by learned counsel for the petitioner that SCC Suit filed by plaintiff-respondent was decreed vide order dated 08.03.2021 and the defendant-petitioner was directed to be evicted from the house in dispute within two months. Against the said order, SCC Revision No.3 of 2021 was preferred in which stay application was moved on 05.4.2021 in which following order was passed :

^^प्रार्थ�ना-पत्र 6 ग प्रस्तुत कर निनगरानीकता� द्वारा अवर न्यायालय द्वारा पारिरत निनर्ण�य@आदेश निदनांनिकत 08-03-2021 का नि�यान्वयन निनगरानी के निनस्तारर्ण तक स्र्थनिगत निकये जाने की याचना की गयी है A

सुना तर्था उपलब्ध प्रपत्रों का अवलोकन निकया A

अवर न्यायालय की पत्रावली के अवलोकन से स्पष्ट है निक निनर्ण�य निदनांनिकत 08-03-2021 में दो माह के भीतर वादग्रस्त सम्पत्ति2 को खाली कर कब्ज़ा दखल देने का आदेश पारिरत निकया गया है A जहाँ तक स्र्थगन निकये जाने का प्रश्न है, अभी दो माह पूरे नहीं हुए है और न ही कोई इज़राय वाद दात्तिखल हुआ है इसत्तिलए नि>ना निवपक्षीग. k को सुने स्र्थगन प्रार्थ�नापत्र पर अभी आदेश पारिरत करने का कोई औचिचत्य नहीं है तर्था निवपक्षीग. k को सुना जाना आवश्यक है A

प्रार्थ�ना-पत्र 6 ग पर भी निवपक्षीग. k को नोनिCस जारी हो A निनगरानीकता� आवश्यक पैरवी अन्दर सप्ताह करें A प्रार्थ�ना-पत्र 6 ग वास्ते सुनवाई निनयत निदनांक को पेश होA^^

The petitioner is aggrieved by the aforesaid order.

As no useful purpose would be served in keeping the matter pending or issuing notice to the contesting respondents, this Court directs the Court below to decide the stay application 6-Ga, filed on 8.9.2021 strictly in accordance with law after hearing the concerned parties, expeditiously, preferably within a period of one month from the date of production of a certified copy of this order before him.

With the aforesaid direction, writ petition stands disposed of.
