On the matter being taken up today, learned counsel for the plaintiff-respondent has apprised to this Court that evidence has already been adduced by the defendant-appellant before the court below and the date is fixed on 01.02.2021 for crossexamination.
Considering the facts and circumstances of the case, once the Court has proceeded to indicate its mind in negative, learned counsel for the appellant has contended that he does not intend to press the present first appeal.
Consequently, the first appeal is dismissed as not pressed.
