This writ petition has been filed praying for the following reliefs:

"i) issue, a writ, order or direction in the nature of certiorari to quash the F.I.R. dated 29.01.2021, in Case Crime No. 40 of 2021, U/s 3(1) of U.P. Gangster and Ante Social activities (Prevention) Act, P.S. Kotwali, District Basti.

(ii) issue, a writ, order or direction in the nature of mandamus directing the respondent Nos. 1 and 2 not to arrest the petitioner in pursuance of the F.I.R. dated dated 29.01.2021, in Case Crime No. 40 of 2021, U/s 3(1) of U.P. Gangster and Ante Social activities (Prevention) Act, P.S. Kotwali, District Basti."

Considering the facts and circumstances of the case and the allegations made in the impugned first information report, the writ petition is disposed off with liberty to the petitioner to apply for bail as permissible under law and in accordance with law.

It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
