This writ petition has been filed praying for following reliefs:-

"I. Issue a writ order or direction in the nature of mandamus commanding the Respondent No.3 Commissioner Azamgarh to decide the appeal within a stipulated time which may be fixed by this Hon'ble Court.

II. That issue a writ order or direction in the nature of mandamus commanding the Respondent No.03 to decide the interim application filed by the petitioner against the externment order 24.02.2021 passed by District Magistrate. Or please to stay the effect and operation of externment order dated 24.02.2021 passed by District-Magistrate against the petitioner till the disposal of Appeal pending before Respondent No.03."

Learned A.G.A. submits that the appeal of the petitioner, filed under Section 6(1) of U.P. Control of Goondas Act, 1970, shall be decided by the respondent No.3 in accordance with law, expeditiously, if it is still pending.

In view of the aforesaid and without expressing any opinion on merits of the case of the petitioner, this writ petition is disposed off directing the respondent No.3, Commissioner Azamgarh Division, Azamgarh, to decide the aforesaid appeal of the petitioner in accordance with law, expeditiously preferably within two months from the date of production of a copy of this order, after affording opportunity to the petitioner and without granting any unnecessary adjournment to either of the parties, if the appeal is still pending.
