As per report of C.J.M., Meerut dated 05.08.2021, the sole appellant- Rajendra Kumar has died on 13.12.2016. This report is supported with the report of S.I., P.S. Delhi Gate, Meerut, death certificate of the appellant- Rajendra Kumar, statements of Rajesh Agarwal and Amit Agarwal both sons of deceased Rajendra Kumar. Both Rajesh Agarwal and Amit Agarwal have stated in their statements that their father has expired on 13.12.2016. They have supplied the death certificate of their father.
The report of C.J.M. Meerut dated 05.08.2021 is, thus, in compliance of circular letter No. 15/2005, VIII-119 April 19, 2005 and 04/Admin G-II dated Allahabad 18.01.2017 same is accepted.
As none of the legal heirs of the deceased has come forward to proceed with the appeal, hence, the appeal is abated.
The appeal is, hereby, dismissed as abated.
