Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. As per impugned FIR, the victim is about 16 years whereas as per high school certificate, her date of birth is 28.05.2005 and she is about 17 years. He further submits that in her statement recorded under Section 164 Cr.P.C., the victim has not levelled any serious allegation against the applicant. The victim has refused for medical examination. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been touched upon at length. It has been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required. He further submits that applicant is having no criminal history and in case he is released on bail, he will not misuse the liberty of bail. The applicant is in jail since 06.04.2021.
