Learned counsel for the applicant has submitted that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. From the possession of the applicant, 467 gm Tramadol medicine, Codine syrup 2.280 kg and 85.3 gm alprozolam medicines are said to have been recovered. The applicant is the brother of the co-accused Ashwani, who have a valid license, which was issued by the licensing authority at District Bareilly. Charge sheet has been submitted in the present case. He has further submitted that nothing has been recovered from the possession of the applicant and the alleged recovery is false and fabricated. There is no independent eye witness of the alleged recovery, which has been shown by the police. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the Court. The circumstances which, according to the counsel, led to the false implication of the applicant have also been touched upon at length. The applicant is having no previous criminal history. The applicant is in jail since 18.06.2021.
