Heard Sri Sudhanshu Singh, learned Counsel for the applicant and Smt. Seema Shukla, learned A.G.A. for the State respondents.
It is contended by learned Counsel for the applicant that the applicant is wholly innocent and has been falsely implicated in the present case. Relying on the case diary material, it has been submitted that the investigation is being deliberately delayed by the informant and the injurued persons who are not getting their statement recorded which fact is mentioned at page 36 of the present application. It is next contended that the co-accused persons Taufiq, Hafiz and Rafiq have been granted bail by a co-ordinate Bench of this Court vide order dated 21.11.2019 passed in Criminal Misc. Bail Application No. 51181 of 2019 as well as vide order dated 8.9.2020 passed in Criminal Misc. Bail Application No.20662 of 2020 respectively. It is also pointed out that the applicant has no criminal history and is in jail since 10.3.2020. In case, the applicant is enlarged on bail, he will not misuse the liberty of bail.
Learned A.G.A. has opposed the prayer for bail but could not dispute the aforesaid facts.
