Heard Sri Vinod Kumar Shukla, learned Counsel for the applicants and Smt. Seema Shukla, learned A.G.A. for the State respondents.

It is contended by learned Counsel for the applicants that the applicants are wholly innocent and have been falsely implicated in the present case. It is further submitted that in the First Information Report nine persons have been named. No specific role has been assigned to the applicants. It is next contended that the injuries sustained by the husband of the informant are simple in nature. It is also pointed out that the applicants have no criminal history and are in jail since 23.11.2020. In case, the applicants are enlarged on bail, they will not misuse the liberty of bail.

Learned A.G.A. has opposed the prayer for bail but could not dispute the aforesaid facts.

Perused the first information report as well as the averments made in the bail application.

Considering the facts and circumstances of the case and also perusing the material on record, without expressing any opinion on the merit of the case, let the applicants Lavkush and Pawan involved in case crime no.213 of 2020, under Sections 147, 323, 504, 506, 294, 325, 308 I.P.C., P.S. Saini, District Kaushambi be released on bail on his furnishing a personal bond and two local sureties each of the like amount to the satisfaction of court concerned on the following conditions that:

the applicants shall not temper with the prosecution evidence.

the applicants shall not pressurize the prosecution witness;

¶12

the applicants shall appear on each and every date fixed by the trial court.

¶13

In case of default of any of the conditions enumerated above, the order granting bail shall automatically be vacated.
