Heard learned counsel for applicant(s), learned A.G.A. and perused the record.

This bail application has been preferred by the accusedapplicant(s), Rajveer, who is involved in Case Crime No. 13 of 2021, under Sections 420, 467, 471, 120B I.P.C. and 66D, 72 of Information Technology (Amendment) Act, 2008 and Section 4/10 U.P. Public Exam Act 1998, P.S.- Lohamandi, DistrictAgra .

Learned counsel for the applicant(s) in support of his prayer for bail submits that the F.I.R of this case crime was lodged against eight accused persons. The applicant is not named in the F.I.R, his name surfaced during investigation and there is no evidence against the applicant except confessional statement of the applicant in which it is alleged that one Arvindra Kumar Yadav has posted one paper on his mobile and that accused Arvindra Kumar Yadav is also not named in the F.I.R and the paper which is alleged to be posted on the wats app on phone of the applicant, the same had also been deleted. The applicant has been languishing in jail since 06.02.2021 having no criminal antecedent.

On behalf of State bail has been opposed.

In view of the facts and circumstances of the case and the submissions made by learned counsel for both sides and going through the record, without commenting on the merits of the case, I find it a fit case for bail.

Let applicant(s), Rajveer, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned with the following conditions:

(i) The applicant(s) shall not indulge in any criminal activity.

¶12

(ii) The applicant(s) shall not tamper with the prosecution evidence.

¶13

(iii) The applicant(s) shall not pressurize the prosecution witnesses.

¶14

(iv) The applicant(s) shall regularly appear on the dates fixed by the trial court unless his personal attendance is exempted by the trial court.

¶15

In case of default of any of the conditions enumerated above, liberty is given to the trial court to cancel the bail of the applicant(s) without any reference to this Court.
