This bail application has been preferred by the accusedapplicant(s) Abhay who is involved in Case Crime No. 300 of 2020 under Sections 392 and 411 I.P.C. P.S.- Aliganj DistrictEtah.

Learned counsel for the applicant has submitted that the FIR of this case crime was lodged against two unknown persons in regard to loot of one Realme blue colour, Comio Silver colour and Vivo black colour mobiles and other Android phones and also a country made pistol which are alleged to be recovered from the possession of the applicant. There is no independent witness of the alleged recovery. There is no evidence in regard to identity of the applicant by the informant. So far as the criminal history is concerned, same has been explained in para 2 of the supplementary affidavit.

Learned AGA opposed the contentions made by learned counsel for the applicant.

In view of the facts and circumstances of the case and the submissions made by learned counsel for both sides and going through the record, without commenting on the merits of the case, I find it a fit case for bail.
