Heard learned counsel for the applicant, Sri Rajeev Chaddha, learned counsel for O.P. No. 2, learned AGA for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed with the prayer to quash the entire proceedings of Case No. 8438 of 2020 (State Vs. Tarkeshwar Singh and another) arising out of charge-sheet dated 28.8.2020 in Case Crime no. 224 of 2020, under sections 419, 420, 406, 504, 506 IPC, P.S. Shahpur, District Gorakhpur pending in the court of A.C.J.M. Court No. 3, Gorakhpur.
Considering the facts and on the request of learned counsel for the applicant, the applicant is permitted to appear before the concerned court within a month from today and move an application claiming discharge. The concerned court shall after hearing, decide the application on merits, in accordance with law, within a period which shall not exceed a period of three months from today.
With the aforesaid directions, this application is finally disposed of.
