The matter was referred to Allahabad High Court Mediation and Conciliation Center and the applicant was directed to deposit Rs.5000/- with the Mediation Center in the name of U.P. Boaring payable at Varanasi and Rs.1,000/- will be deposited in the Mediation Center.
On 02.05.2010, Mediation Center has submitted a report that the parties are not willing for the mediation. The Mediation Center has submitted a report that the third party has not appeared and collected the expenses awarded and deposited at the Mediaton Center. Thereafter, the case was listed on 03.09.2011 and 24.04.2012 and on both the occasions the case was adjourned on the ground of illness.
Today, when the matter was taken up, no body is present on behalf of the applicant even in the revised call.
The application is accordingly dismissed for non-prosecution.
Interim order, if any, stands vacated.
